SWAPTU - TERMS AND CONDITIONS 

 

1. Introduction 

1.1. These Terms and Conditions ("Terms") constitute a legal agreement between Swaptu ("Swaptu", "we", "us", "our"), established and registered under the laws of Sweden, with its registered office at [Company Address], Sweden, and individuals and entities ("you", "user", "customer") who use the Swaptu platform ("Platform") and services offered by Swaptu ("Services"). 

1.2. You can access and use our Services through our website at www.swaptu.com and all related mobile applications, APIs, or other platforms.

By accessing our Services, using our Services, or creating a Swaptu account, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy (defined below). If you do not agree to these Terms, do not access or use our Services. 


2. Eligibility 

2.1. To use our Services, you must be at least 18 years old and have the legal capacity to use our Services. It must be legal for you to use our Services under the laws of the jurisdiction in which you reside.

3.4. Identity Verification: Due to legal regulations and legal obligations, we may require you to verify your identity (KYC - Know Your Customer) and provide necessary additional information before using our Services. This information may include a copy of your identity document, proof of address, and other personal information. You agree to comply with identity verification processes. 


4. Transactions and Trading 

4.1. Through our Platform, you can buy, sell, exchange, and perform other transactions with cryptocurrencies. You acknowledge that transactions and trading carry significant risks, and cryptocurrency values can be volatile. 

4.2. Orders and Transaction Confirmation: When you place an order on the Platform, you authorize us to execute your order at the specified price and conditions. Successful execution of your orders is not guaranteed. Your order may be partially or fully executed, or not executed at all, depending on market conditions, liquidity, and other factors. It is your responsibility to carefully review transaction details and fees before placing orders. 

4.3. Transaction Fees: Fees may apply to transactions on our Platform. Our default transaction fees are 0.15% for Maker orders and 0.20% for Taker orders. More information about fees can be found on our website and may be updated from time to time. It is your responsibility to review the applicable fees before making transactions. Different fee rates may apply for special cases or promotions. In such cases, the relevant fee information will be clearly stated on our Platform. 

4.4. Market Manipulation and Illegal Activities: You agree that you will not use our Platform for any illegal or unauthorized purposes. Market manipulation, insider trading, money laundering, terrorist financing, and other illegal activities are strictly prohibited. If you engage in such activities, your account may be suspended or terminated, and legal action may be taken. 


5. Deposits and Withdrawals 

5.1. You can deposit cryptocurrencies into your account and withdraw cryptocurrencies from your account. Certain limits and procedures may apply to deposits and withdrawals. These limits and procedures can be found on our website and may be updated from time to time. 

5.2. You acknowledge that deposits and withdrawals may take a certain amount of time and that transaction times may vary depending on network congestion and other factors. 

5.3. Swaptu cannot be held responsible if you provide incorrect addresses or information for cryptocurrency deposits and withdrawals. It is your responsibility to ensure the accuracy of transaction details. 


6. Intellectual Property 

6.1. All intellectual property rights related to our Services, including our Platform, website, logos, trademarks, and content, belong to Swaptu. You may not copy, modify, distribute, or create derivative works from these materials without our prior written consent. 

6.2. We license our Services to you for your personal and non-commercial use only. Except as expressly stated in these Terms, you do not acquire any rights in or to our Services or content. 


7. Limitation of Liability and Disclaimer 

7.1. OUR SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE MAKE NO WARRANTIES, EXPRESS OR IMPLIED, ABOUT OUR SERVICES OR CONTENT, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. 

7.2. SWAPTU AND ITS DIRECTORS, EMPLOYEES, PARTNERS, OR SUPPLIERS SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OUR SERVICES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR MARKET FLUCTUATIONS, NETWORK PROBLEMS, WALLET ERRORS, SECURITY BREACHES, HUMAN ERROR, OR OTHER REASONS. 

7.3. YOU UNDERSTAND AND AGREE THAT CRYPTOCURRENCY TRADING IS HIGH RISK AND THAT THERE IS A RISK OF LOSS. YOU ARE SOLELY RESPONSIBLE FOR YOUR TRADING DECISIONS AND TRANSACTION ACTIVITIES. 


8. Indemnification 

8.1. You agree to indemnify and hold harmless Swaptu, its directors, employees, partners, and suppliers from and against any loss, damage, claim, suit, cost, or expense (including reasonable attorneys’ fees) arising out of or related to your breach of these Terms, misuse of our Services, or violation of any law or third-party rights. 


9. Termination 

9.1. You may close your account at any time. We also reserve the right to suspend or terminate your account at any time and for any reason, including but not limited to the following: * Your breach of these Terms. * Our need to comply with legal regulations or legal requests. * Your engagement in suspicious or illegal activities. * Our decision to discontinue offering our Services. 

9.2. Upon account termination, it is your responsibility to withdraw any remaining balance. Any remaining balance after a certain period following account termination will be processed in accordance with applicable laws and our policies. 


10. Governing Law and Dispute Resolution 

10.1. These Terms and the use of our Services are governed by and construed in accordance with the laws of Sweden. 

10.2. Any dispute arising out of or in connection with these Terms or our Services shall be subject to the exclusive jurisdiction of the courts of Sweden.
